01 Access to our site
The website available at https://pamoldigital.com and related pages (the "Site") are provided by Pamol Digital Pty Ltd ("Pamol Digital", "we", "us", or "our"), a South African software product company. These Website Terms of Use ("Terms") govern access to, browsing of, and use of the Site.
By accessing or using the Site, you agree to these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree, you must not access or use the Site. If you have questions about these Terms, contact support@pamoldigital.com.
"User", "you", and "your" refers to the person using the Site and, if you use the Site on behalf of an organisation, that organisation. If you use the Site on behalf of a company or other entity, you represent that you are authorised to accept these Terms on its behalf.
The Site provides general and business information about Pamol Digital, our products, and related services. Product descriptions, availability, pricing, and features may change at any time. Separate product, app, subscription, platform, or service terms may apply when you subscribe to or use a specific Pamol Digital product. If those terms conflict with these Terms, the product-specific terms will apply for that product.
02 Pamol Digital's responsibility
We make reasonable efforts to keep the Site available, accurate, secure, and up to date. However, the Site is provided for general information purposes, and we do not guarantee uninterrupted access, error-free operation, or that all content will always be complete, accurate, or current.
We may amend, remove, update, suspend, or discontinue any Site content, configuration, presentation, or feature at any time without prior notice. You are responsible for using appropriate care and judgement when accessing the Site or relying on information available through it.
03 User responsibility and acceptable use
You may not use the Site or any Pamol Digital product to break the law, infringe rights, upload harmful code, attempt unauthorised access, disrupt service performance, scrape or misuse content, misrepresent your identity, interfere with security, or use our systems in a way that harms other users, Pamol Digital, our collaborators, or our reputation.
04 Product accounts and user content
Some products may require an account. You are responsible for providing accurate information, keeping login details secure, and all activity that occurs through your account unless caused by our failure to apply reasonable security measures.
Users may create, upload, store, or process business documents and related data inside our products. You remain responsible for your content, including invoices, estimates, client information, tax information, payment details, files, notes, and documents generated through a product. You must ensure that you have the right to provide and use that content.
05 Confidentiality
We treat non-public user information submitted through our products as confidential. We use it to provide, support, secure, and improve our products, and we do not disclose it except to personnel, service providers, affiliates, or other parties who need access for those purposes and who are expected to protect it, or as otherwise described in our Privacy Policy.
Confidentiality obligations do not apply to information that is already known to us without confidentiality restriction, becomes public without our breach, is received from a lawful third-party source, is independently developed, is made public by you, or must be disclosed under law, regulation, court order, or competent authority request.
06 Intellectual property
Pamol Digital, product names, website content, software designs, source code, user interfaces, trademarks, brand assets, documents, graphics, text, and related materials are owned by Pamol Digital Pty Ltd or licensed to us by their respective owners unless stated otherwise.
Except where expressly allowed by law or written agreement, you may not copy, reproduce, distribute, communicate to the public, modify, adapt, translate, reverse engineer, resell, exploit, or otherwise misuse our intellectual property.
07 Payments and third-party services
Products may connect to payment gateways, authentication providers, hosting services, analytics services, storage providers, app stores, support tools, communication platforms, or other third-party systems. Those services may have their own terms and privacy practices. Pamol Digital is not responsible for third-party services outside our control.
08 Limited warranty and disclaimer
We aim to provide our websites and products with commercially reasonable care and skill. Except where a separate written agreement says otherwise, the Site and related content are provided "as is" and "as available".
To the maximum extent allowed by applicable law, Pamol Digital disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and error-free operation.
Our products support business workflows but do not replace professional legal, tax, accounting, or financial advice. You are responsible for checking document accuracy, tax treatment, payment details, legal requirements, and business suitability before sending, signing, relying on, or filing generated documents.
09 Limitation of liability
To the maximum extent allowed by law, Pamol Digital Pty Ltd will not be liable for any indirect, special, incidental, compensatory, consequential, exemplary, or punitive damages, including loss of profit, revenue, data, goodwill, business opportunity, work disruption, system failure, or other commercial loss arising from access to, use of, or inability to use the Site or our products.
Pamol Digital is not responsible for liability arising from third-party websites, third-party services, or material linked through the Site. Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.
10 Suspension and termination
We may suspend or terminate access if a user violates these terms, creates security or legal risk, fails to pay where payment is required, or uses a service in a harmful way. Users may stop using our products at any time.
11 Electronic communications
You consent to receive electronic communications from us, including notices about support requests, product updates, account activity, fees and charges, transactional information, privacy and legal notices, and other service-related information. Electronic communications satisfy any legal requirement that communications be in writing where permitted by law.
12 Severability and waiver
If any part of these Terms is found invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining Terms will continue in effect. Our failure to act on a breach does not waive our right to act on that breach or any later breach.
13 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign, transfer, or delegate our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or operation of our business.
14 Governing law and jurisdiction
These terms are intended to be interpreted under the laws applicable to Pamol Digital Pty Ltd as a South African company, unless another binding agreement or mandatory consumer law requirement applies. Where legally permitted, disputes relating to these Terms or the Site will be handled by the courts or competent forums of South Africa.
